Uncompromising Safety & Full Regulatory Compliance

In the world of luxury yachting, safety and legal compliance are the non-negotiable foundations. At Phinisi Factory, we adhere to the most stringent standards, including the International Convention for the Safety of Life at Sea (SOLAS) and Indonesia’s Law No. 17 of 2008 on Shipping. This foundational law governs every aspect of maritime activity in the archipelago, from vessel registration to port authority operations. Our clients invest with confidence, knowing their asset undergoes a rigorous, multi-stage certification process lasting over 120 days. This journey includes key milestones such as keel-laying verification, hull integrity and welding inspections, stability testing, and extensive sea trials in the Bali Strait. This page outlines our comprehensive corporate and maritime compliance framework, designed for absolute peace of mind in the world’s largest archipelago.

Corporate & Legal Standing

Phinisi Factory operates as a fully legal PT PMA (Foreign Investment Limited Liability Company), registered under Indonesian Law No. 40 of 2007. This structure provides our international clients with maximum legal protection and secure asset ownership under Indonesian law. As a tax-compliant entity with a registered NPWP (Taxpayer Identification Number), we provide our clients with a secure and professional partnership, ensuring every transaction is transparently documented and reported in our annual tax filings (SPT Tahunan).

  • Legal Entity: We are a registered Indonesian Limited Liability Company, or Perseroan Terbatas (PT), operating under the reputable Juara Holding Group. This provides a stable and accountable corporate backbone for every project.
  • Business Licensing: We hold a valid Business Identification Number (Nomor Induk Berusaha – NIB) and all necessary operational licenses from the Indonesian government’s Online Single Submission (OSS) system, ensuring our shipyard operations are fully authorized.
  • Tax Compliance: We are a registered taxpayer with a Taxpayer Identification Number (Nomor Pokok Wajib Pajak – NPWP) and are fully compliant with all corporate tax and VAT (PPN) regulations, with all payments and reports filed on time.
  • Employee Welfare: All our employees, from our executives to our shipyard craftsmen, are legally employed and registered for Indonesia’s mandatory social security (BPJS Ketenagakerjaan) and universal healthcare (BPJS Kesehatan) programs. This commitment to our 75+ local artisans and their families ensures a stable, highly skilled, and motivated workforce dedicated to their craft.

Maritime Classification & Shipbuilding Standards

Every Phinisi Factory yacht is constructed to meet and exceed the standards of Biro Klasifikasi Indonesia (BKI), the national classification society and a member of the International Association of Classification Societies (IACS). We go further by incorporating specific RINA (Registro Italiano Navale) pleasure yacht guidelines, ensuring our hull construction, crafted from certified Kalimantan ironwood, withstands pressures well over the 1,200 PSI minimum requirement.

  • Biro Klasifikasi Indonesia (BKI) Class: All our vessels are built under the survey and to the standards of BKI. This involves rigorous, phase-by-phase inspections of materials, structural plans, welding qualifications, and construction quality, culminating in the issuance of a BKI Class Certificate. This certificate is a non-negotiable prerequisite for securing a commercial charter license (SIUPKK) and obtaining premier commercial insurance and international chartering rights. Upon client request, we can also build to dual-class standards with international bodies like RINA or Lloyd’s Register.
  • Ministry of Transportation (Kemenhub) Compliance: We work directly with the Direktorat Jenderal Perhubungan Laut (Ditjen Hubla) to ensure every vessel complies with Indonesian shipping law. This includes securing the Gross Akte (Certificate of Registry), which serves as the vessel’s official “birth certificate” and proof of Indonesian flagging, and the Surat Ukur (Tonnage Certificate), which is essential for calculating port duties and operational permits.
  • International Convention Adherence: Our designs and safety outfitting comply with the key principles of international maritime conventions as enforced by Indonesian law, including:
    • SOLAS (Safety of Life at Sea): Governing the installation of all safety equipment for GMDSS Sea Area A3 operations, including Furuno communications systems, McMurdo EPIRBs, SARTs, Viking-brand certified life rafts, and professional-grade CO2 and foam fire suppression systems in the engine room and galley.
    • MARPOL (International Convention for the Prevention of Pollution from Ships): Dictating the installation of compliant systems to protect Indonesia’s pristine marine environments. This includes adherence to Annex I (Oil) via certified oily water separators and Annex IV (Sewage) through the installation of Type II Marine Sanitation Devices (MSDs) that treat waste to the highest standards before discharge.

Operational Safety Protocols

Beyond the build, we ensure our vessels are equipped for safe operation in demanding archipelagos like Raja Ampat and Komodo National Park. Each yacht is fitted with modern navigation systems, including a Furuno radar, chartplotter with detailed C-MAP charts, and a depth sounder. Safety gear, like a 406 MHz EPIRB and a full set of pyrotechnics, exceeds the minimum requirements for cruising over 100 nautical miles from shore.

  • Certified Crewing Standards: We strongly advise and assist our clients in hiring crew who hold valid STCW (Standards of Training,Certification and Watchkeeping for Seafarers) certifications. This includes not just Basic Safety Training (BST) but also specialized credentials like Advanced Fire Fighting (AFF), Medical First Aid (MFA), and a licensed Radio Operator (ORU) for managing long-range communications.
  • Advanced Navigation & Tracking: Our standard package includes professional-grade navigation systems, a Class A AIS (Automatic Identification System) for collision avoidance, and satellite-based GPS tracking providing location updates every 15 minutes for remote monitoring by shore-based management.
  • Emergency Preparedness: Each vessel is delivered with a comprehensive set of Emergency Response Plans (ERPs) covering scenarios from man-overboard to medical evacuation. These plans are developed in line with best practices and designed for direct coordination with Indonesia’s National Search and Rescue Agency (BASARNAS) and the local Port Authority (KSOP). We also mandate and help facilitate quarterly safety drills for the crew.

Navigating Indonesia’s Unique Maritime Conditions

Our commitment to safety extends to preparing vessels and crew for the specific challenges of Indonesian waters. The archipelago’s 17,000 islands present dynamic conditions that change with the seasons. During the primary East Indonesia cruising season (April to October), the weather is generally stable, but navigating areas like the Komodo National Park requires expert knowledge. The tidal currents in the Lintah Strait, for example, can exceed 8 knots, and our captains are trained to transit these passages only during slack tide. Conversely, during the west monsoon (November to March), routes are adjusted to sheltered areas, and heightened watch is maintained for unpredictable squalls. In remote regions like Raja Ampat, which can be over 150 nautical miles from the nearest major port of Sorong, self-sufficiency is paramount. Our vessels are equipped with redundant systems, extensive spare parts, and watermakers capable of producing over 4,000 liters per day to ensure operational autonomy and safety far from shore support.

Our meticulous approach to safety and compliance is a core part of our value proposition, qualifying our yachts for premier P&I (Protection and Indemnity) insurance coverage from members of the International Group of P&I Clubs. This protects our clients’ multi-million dollar investment, ensures guest safety, and upholds our integrity as Indonesia’s leading Phinisi builder.
